Empirical SCOTUS: The recent role of separate opinions

In a 2015 article for The Washington Post reviewing Melvin Urofsky’s book, “Dissent and the Supreme Court,” David Cole wrote, “What determines a great dissent … is not necessarily the power of the argument but the shifting tides of history. … History, not rhetoric or cogency, determines whether a dissent wins out in the long run. Yet by articulating a compelling alternative legal vision, a persuasive dissent can contribute to the arc of historical change.” […]

Where is the client-facing innovation in law practice?

Not long ago, I attended one of the typical “future of the legal industry” conferences in Denmark. All the usual speakers were there: A chief information officer from a large law firm talked about experiences with implementing a solution about two years ago; a consultant talked about breaking down silos and showed graph after graph in an effort to convince law firm leaders that they are doomed unless they go digital tomorrow; and of course, […]

No Police, No Peace? Maybe Not

Some cash-strapped municipalities can’t afford law enforcement. But is having no police such a bad thing? Not when they’re corrupt “bad apples.” Who doesn’t consider their local police department to be a standard feature of modern municipal civilization, much like the water treatment plant and garbage collection, that keeps us safe but which mostly exists in the background, taken for granted until needed? Yet these services cost money, and when the economy takes a hit, […]
